End User License Agreement (EULA) for MzFit

1. Introduction

Welcome to MzFit! This End User License Agreement (“EULA”) is a legal agreement between you (“User”) and MeeZeeCo, LLC (“Company”) governing your use of the MzFit application (“App”). By downloading, installing, or using the App, you agree to be bound by the terms of this EULA.

2. License Grant

MzFit grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App solely for your personal, non-commercial purposes, strictly in accordance with the terms of this EULA.

3. Restrictions

You agree not to, and you will not permit others to:

Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the App.

Use the App for any purpose that is illegal or prohibited by this EULA.

Use the App in any manner that could damage, disable, overburden, or impair the App or interfere with any other party’s use of the App.

4. Intellectual Property

All intellectual property rights in the App, including but not limited to copyrights, patents, trademarks, and trade secrets, are owned by MzFit or its licensors. This EULA does not grant you any rights to such intellectual property.

5. Third-Party Content

MzFit relies on content from YouTube for some of its features. By using the App, you agree to comply with YouTube’s Terms of Service and Privacy Policy. MzFit is not responsible for the availability or accuracy of any YouTube content.

6. Billing and Distribution

Billing and distribution of the App are managed by Apple Inc. By downloading the App from the Apple App Store, you agree to comply with Apple’s Terms and Conditions and Privacy Policy. MzFit is not responsible for any issues related to billing or distribution managed by Apple.

7. Termination

This EULA is effective until terminated by either party. Your rights under this EULA will terminate automatically without notice from MzFit if you fail to comply with any term(s) of this EULA. Upon termination, you must cease all use of the App and delete all copies of the App.

8. Disclaimer of Warranties

The App is provided “as is” and “as available,” with all faults and without warranty of any kind. MzFit disclaims all warranties, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

In no event shall MzFit be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the App; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the App; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the App; and/or (vi) the defamatory, offensive, or illegal conduct of any third party.

10. Governing Law

This EULA shall be governed by and construed in accordance with the laws of the state of Georgia in the United States of America, without regard to its conflict of law principles.

11. Changes to this EULA

MzFit reserves the right to modify this EULA at any time. If we make changes to this EULA, we will provide notice of such changes, such as by sending an email, providing notice through the App, or updating the “Last Updated” date above. Your continued use of the App following the posting of changes will mean that you accept and agree to the changes.
